Karnataka Puts Tobacco on One Year Timeout, Gutka Sellers Left Chewing the News

The Karnataka government has prohibited the sale and distribution of gutka, pan masala and other products containing tobacco or nicotine across the State for a period of one year. Following the prohibition, the Food Safety and Drugs Administration Department has intensified enforcement measures targeting the manufacture, storage, transportation and sale of the prohibited product. The move is aimed at restricting the availability of tobacco and nicotine containing products in the State. Fresh Prohibition Under Food Safety Law The latest order has been issued under Section 30(2)(a) of the Food Safety and Standards Act, 2006, along with Regulation 2.3.4 of the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011. The provisions give authorities the legal framework to prohibit or restrict the sale of certain food products when required on food safety grounds. Karnataka Has Banned Such Products Before This is not the first time Karnataka has imposed restriction on tobacco containing gutka and pan masala. The State had earlier banned their manufacture and sale in 2013, during the previous tenure of U.T. Khader as Health Minister. The fresh prohibition brings the issue back into focus, with enforcement agencies now tasked with preventing the prohibited products from being manufactured, stored, transported or sold within Karnataka. Enforcement to Be Stepped Up With the new order in force, authorities are expected to monitor businesses and supply chains dealing with the affected products. The enforcement focus covers multiple stages, from manufacture and storage to transportation and retail sale. The one year prohibition therefore goes beyond simply restricting shop sales, placing restrictions across the wider supply chain of tobacco and nicotine containing gutka and pan masala.
