Judicial Backup Plan Activated: Safeguards Before Statute

High Court Examining Need for Interim Safeguards During proceedings in May, the Bombay High Court indicated that it would examine whether temporary directions could be issued to ensure the safety of advocates until comprehensive legislation is enacted by the Maharashtra government. The court is currently hearing a Public Interest Litigation (PIL) filed by the Kolhapur District Bar Association and other petitioners. The plea seeks protective measures for more than two lakh advocates practicing across Maharashtra, arguing that attacks on legal professionals have become increasingly frequent and require immediate institutional intervention. The Bombay High Court had taken suo motu cognisance of the incident in March, treating the matter as one involving broader public importance beyond the individual case. However, until the Bill becomes law, advocates continue to rely on existing criminal provisions and judicial remedies in cases involving attacks or threats. Telangana Moves Ahead with Advocate Protection Law The debate in Maharashtra comes shortly after Telangana implemented its own law providing statutory protection to advocates.
